H.E.Butt Grocery Chain settles slip & fall case during pretrial

H.E. Butt Grocery, a leading grocery chain in Texas and the nation's 15th largest grocery chain in revenue, has chosen to forgo a jury trial and settle a lawsuit brought by Teresa Obregon.

Obregon filed suit against the grocer on June 2010, alleging the grocery store's negligence caused her to fall while shopping. Obregon claims she was in the process of buying groceries at H.E.B. when she sustained serious injuries after falling due to a "dangerous condition." According to the complaint, Obregon claimed the fall resulted in significant medical costs, physical pain, suffering, mental anguish and physical impairment, lost earnings and a decreased earning capacity.

Obregon blamed the grocery store for causing her fall, saying it negligently failed to properly inspect the flooring area in question, failed to maintain the floor in a safe condition, failed to provide her with adequate warnings, failed to remove a hazardous condition causing the slip and fall and failed to remove the hazardous condition in a reasonable time.

The case was set to go to trial; however during pretrial proceedings, the parties reached a settlement. The settlement amount was not immediately disclosed.
