Texans file lawsuit after being rear-ended by a tractor trailer truck

Two Texas residents Anita and Shawn Sieracki filed a suit against Leoni G. Estrada and Con-Way Truckload Inc. after her vehicle was rear ended by a tractor-trailer.

The incident occurred in April as Anita Sieracki was traveling on an interstate freeway. Anita was rear-ended by a tractor-trailer driven by Estrada, causing her vehicle to strike the retaining wall.

The plaintiff claims that the defendant Estrada was negligent for failing to maintain proper control of the vehicle, failing to keep a proper lookout, failing to apply the brakes in a timely manner, driving with willful disregard for the safety of others, for being inattentive, and for failing to maintain an assured clear distance between the two vehicles.

The truck company Conway Truckload is being sued for negligence for hiring the driver, failing to investigate the driver's driving ability, and for poorly training, supervising and implementing safety policies and procedures.

Anita is requesting a jury trial and is seeking damages for permanent injuries, physical impairment, disfigurement, loss of wage and earning capacity and medical expenses, and court expenses. Shawn is seeking damages for mental anguish, loss of household services, and spousal consortium.
