Family settles for $6.2 million after a truck accident kills wife

Taibitha Carroll was killed in October 2008 when Jeffrey Repec, driving a tractor trailer for Geils Famrs, rear-ended the pickup truck Carroll was riding along with her husband, Randy, and three year-old son, Gabriel.

The family was on its way to a nearby pumpkin patch at the time of the incident. Taibitha was pronounced dead at the scene and Randy suffered a broken spine, respiratory failure, and facial fractures; Gabriel suffered two broken legs, severe head injuries, and lacerations.

The driver Repec was found to be driving at a very high speed under the influence of marijuana. He pleaded guilty under influence of drugs and is, currently, serving a 45-month prison sentence.

It was also discovered that Geils Farms failed to conduct legally required random drug tests on its drivers and failed to perform background checks on its drivers. Additionally, Repec's truck was found to be legally overloaded at the time of the incident.

Geils Farms has settled with the family for $6.5 million - $4.7 for Carroll's death, $1.5 million for Randy's injuries, and $300,000 for injuries Gabriel suffered.
