Plaintiff suffered brain injury when stopped car was struck twice

Robert McCullough Jr. was awarded $19.3 million from State Farm Auto Insurance after suffering from brain injury and other injuries after an auto accident.

In April 2005, Robert McCullough Jr., was stopped at an intersection, waiting to turn left, when his vehicle was suddenly struck from behind by another car, which was being driven by Noreen Gysbers. The impact caused McCullough's vehicle to collide with another call driven by Cahee Wilson.

McCullough suffered from a severe brain injury, chest trauma, a collapsed lung, and other injuries. McCullough has lost permanent cognitive abilities and has limited use of his right arm and right leg. He walks using a cane and cannot continue working as a plumber.

McCullough sued both Wilson and Gysbers claiming negligence on their behalves. The jury found that Wilson was not liable for negligence because she did not have enough time to avoid the collision with the plaintiff. The jury awarded McCullough $4.4 million in damages against Gysbers and her insurance company State Farm Insurance. The verdict includes compensation for medical costs, lost wage and earning capacity, pain, suffering, and disability.
