The Michigan appellate courts have not yet settled on whether claims for lack of proper care, supervision, and/or facilities in a nursing home setting that leads to injury or death sounds in ordinary negligence or requires professional standard of care testimony. If the former, the proofs are simpler and less expensive. If the latter, the proofs are much more stringent and costly, and there are "caps" on any recovery.
